Vander Plaats raising money to ‘remove remaining four justices’

By Jason Hancock | 12.29.10 | 7:54 am

Bob Vander Plaats and his newly formed organization, The Family Leader, is hoping to raise $8,000 before the end of the year in order to remove the four remaining Iowa Supreme Court justices over their 2009 ruling that legalized same-sex marriage.

In an e-mail to supporters, Vander Plaats points to the results of November’s judicial retention election, which saw voters oust three justices from the bench, as justification for the other four justices to resign. The e-mail never goes into detail about what, exactly, the money would be used for or how it would help remove the judges, but it does set a Jan. 1 deadline to raise $8,000.

“All seven justices are guilty of overstepping the line by their votes in the Varnum decision, therefore we are asking for the remaining four justices to resign in an orderly fashion,” he said. “As long as the Iowa Supreme Court is comprised of justices that abuse their authority, the credibility of our court will be compromised.”

Vander Plaats led the campaign to oust the three judges, with nearly $1 million in funding from out-of-state anti-gay organizations like the American Family Association, the Family Research Council and the National Organization for Marriage. After the election, he was named CEO and president of The Family Leader — an umbrella organization consisting of the Iowa Family Policy Center, the Iowa Family PAC and Marriage Matters.

He has consistently called for the judges left on the bench to resign, an opinion that caused the conservative editorial board of The Sioux City Journal to conclude Vander Plaats has officially “jumped the shark.”

This loser is an affront to the way our democracy works. He should learn something about the job of the courts in our government and stop calling them activist when he doesn’t like their decision because it allows for gay people to get married. They did their job, and it was a unanimous decision. By some republican and democratic appointed justices. You are an out-of-touch failure sir. You succeeded in firing three good justices in a messed up system where we elect judges, who are supposed to be non-partisan. It’s really sad. The majority of Iowans are not smart enough to understand the complexities of the US Courts, Iowa courts, our legislature, or the Constitution. Let alone allowing them to control by vote the fate of judges, and especially minority groups. That is tyranny by the elderly, out of touch majority. Bob Vander Plaats is clearly wrestling with his own issues. He needs to join a worthy, productive cause, and not further hate and evil by attacking gay people’s civil rights.

Actually, they’re nominated by committee and confirmed by the governor. Then after a trial, and every 8 years of their term, we vote on keeping ‘em.

I’m optimistic that these judges will land on their feet, and may even do better if they, for example, hop on the speaker circuit and do speeches on prioritizing the constitutional rights of all at univeristies and other traditionally more open-minded fora. They’re well respected; it’s definitely a huge loss for Iowa, but idiots deserve to get what they ask for.

For me, the tragedy is that now our legislature is being hijacked by this narcissist so they can take sides on what, to most Iowans, wasn’t even an issue a year ago. We’re paying a salary to these mouthbreathers for a reason…to run the state. Can we maybe look at things which actually affect Iowans? How about the economy? Environment? Education? Runaway healthcare costs? Immigration, legal and otherwise? Public health issues? Infrastructure?

Equally tragic to me is that, when BVP and his band of hysterics discovered most of us just don’t care if there are OMG gays in Iowa getting married, they changed their tactics and claimed Iowa judges had created a law by legalizing gay marriage. And Iowans, even well-educated ones, fell for it in droves. Because we do want our government to follow its own rules, and the mere rumor of corruption makes us look at our eastern neighbor and react in horror. But it’s all based on a deliberate mislabelling of what their decision really did.

The Supreme Court did not make a law. It’s confusing, of course, because headlines read ‘Iowa Court Legalizes SSM.’ It would have been accurate to say they struck down a law limiting marriage only to a heterosexual couple as violating the equal treatment under the law guaranteed by our Constitution. Why wasn’t it said that way? Maybe because it’s wordy, or seems like the double negative version of the same concept (although it’s not). Maybe because to say that a ban on SSM violates the Constitution suggests that gay marriage was already constitutionally legal, as mindblowing as that is. The interesting thing is, the more you read it, the clearer it is that, without a deliberately discriminatory amendment to the contrary, gay marriage has been legal the whole time! We just didn’t recognize it until the SC wrote a clear explanation.

So BVP and his goons can rant and rave, demand impeachments, and sling accusations. They can hurt some very honorable people who did what was right, rather than what was semi-popular. They can even go so far as to rewrite our judicial selection process to mirror that of more corrupt states by making it political rather than merit-based. But without a Constitutional amendment to legalize discrimination based on sexual orientation, they cannot ban gay marriage and hope to have it stand.

Bob Vander Plaats will do whatever it takes to amend our Constitution at the earliest possible time. What he is doing now is biding his time and keeping the issue alive until that time comes.

In addition to attacking our justices, Bob Vander Plaats is mounting a campaign against State Senator Mike Gronstal who is one of our biggest supporters of equality. Vander Plaats will be working to shape the State Legislature in order to get a constitutional amendment passed.

Where can I go to raise money to oppose BVP?

That’s what I am wondering. One Iowa might be the logical choice but I don’t see where they are making a serious effort to take a stand against this guy. I am not meaning to disparage One Iowa’s efforts as they have done quite a bit for equality in Iowa. We need a serious effort focused on opposing Bob Vander Plaats and his organization.

This is truly revolting that justices are being singled out and punished for understanding the constitution and interpreting it perfectly. I am sickened by this effort. If you think there is something wrong with homosexual marriage – then do not marry a person of your same sex! Do not, however, EVER be confused about your power to tell other Americans how to live or think for one moment that you are entitled to legal rights that other Americans are not.
