Smoldering culture clashes reignite in Postville

Defense attorneys for Sholom Rubashkin continue to assert that their client, despite being recently convicted on 86 fraud-related charges, is not a flight risk and should be granted bail pending sentencing.

Late last week U.S. District Chief Judge Linda R. Reade ruled that Rubashkin, who served as the on-site manager at a Postville kosher meatpacking plant that was raided by federal authorities in May 2008, should be held without bail, pending his upcoming sentencing on numerous fraud and money laundering charges. This week, defense attorneys for Rubashkin filed an appeal of that decision, and have requested the court to impose more sanctions on their client to ensure his lack of flight.

…Defendant Rubashkin would respectfully submit a continuation of the prior conditions with additional conditions will ensure Defendant’s appearance at sentencing or any other court proceeding. On November 18, 2009, Defendant Rubashkin presented evidence that individuals stood ready and willing to post equity in their homes which totaled nearly $8,000,000. Additionally, sacred religious scrolls of nearly $500,000 were offered; the significance of the same in the Jewish religion, however, is priceless. Additionally, Defendant Rubashkin has requested the Court consider evidence presented at pretrial detention hearing. … Conditions such as curfew, home detention, or home incarceration may be ordered. Moreover, the Court may now subject Defendant Rubashkin to 24-hour armed surveillance and order Defendant Rubashkin to pay for the same…

Rubashkin and his wife, Leah, reside in the Postville area and are in the process of raising 10 children. One of the younger children, a son, has a developmental disability and, according to documents filed with the court, is extremely close to his father.

The Jewish community in Postville and beyond has long argued that Rubashkin’s religious faith and the bonds that he has formed in Iowa would prevent him from fleeing charges or criminal conviction.

In a perhaps naive move to show their solidarity and support of the Rubashkin family, some members of the Jewish community in Postville have placed signs in their windows and yards that placed a photograph of Rubashkin on top of an American flag with the phrase, “Send Sholom Home!” The signs, which area military veterans viewed as being akin to support signs for Prisoners Of War, have reignited cultural unrest within Postville, and are being offered up as further proof that the insular Jewish community there doesn’t fully understand the social ramifications of its actions, however well-meaning.

In the wake of Rubashkin’s conviction, University of Iowa professor Stephen Bloom, who authored a 2000 book about Postville, told The Iowa Independent that he knew “from the very beginning [that] almost all of Sholom Rubashkin’s actions reflected an mind-boggling sense of imperial disregard for just about everything that ethical, law-abiding people hold as plain and simple rules of civic and financial engagement.”

“Rubashkin always played very fast and very loose. He and his lieutenants seemed to be not just above the law, but above how employers and business people normally carry out their everyday tasks. There was an air of supreme arrogance swirling around Rubashkin and his men, particularly when it came to paying bills and accounting for those bills.”

Because the Rubashkin family came to Postville to begin a new community instead of joining with the existing one, Bloom said that a certain culture clash was simply inevitable.

“The larger issue to me wasn’t so much blending into the existing culture, it was a sense that Rubashkin and his men had come to town and really didn’t give a damn about anyone or anything — except making money their way. They were the new guys in Northeast Iowa, and what they said, went. If you didn’t like it, well, that was just too bad,” he said.

The sentiment of “you better get used to how we do business because we call the shots now” was one Bloom and others came to expect from Rubashkin and others within the Jewish community.

Bloom also predicted that the guilty verdict would spur “scores of Rubashkin loyalists to scream” anti-Semitism. Indeed, just hours after Rubashkin was taken into custody, the official a prominent Chabad Web site asserted that Rubashkin had been denied basic religious rights by federal authorities, and in the comments to that post as well as others on the site it has been suggested that “a frumer yid” doesn’t “deserve to be in jail together with goyishe criminals”:

He made some mistakes, I’mm sure he would not repeat, given what he is facing now. However, does a frumer yid deserve to be in a jail together with goyishe criminals? Absolutely NOT! EVERY SINGLE STOP needs to be pulled out to free him! INSTEAD of sending aroisgevorfener e-mails and faxes to stupid goyim – you should be banging down the doors of ALL “shluchim” who sat and ate like chazeirim at a “gala banquet” and who know and have contacts with key political top-dogs, that can have influence with senators, governors, congressmen/women, presidents, etc. THESE ARE THE ONES THAT YOU SHOULD MAKE THIER LIFE A LIVING H**L UNTIL they do something! that’s the only way anything can change for Sholom Mordechai. (al pi tevah) CALL, CALL, CALL, WRITE, FAX, FAX, FAX, 10-20-30 times a day until they poshut go nuts – and then they will do something! WHAT GOOD ARE THEY, AND WHAT GOOD ARE THIER CONNECTIONS IF NOT FOR THIS INYAN!? At least, if they are not doing the Rebbe’s shlichus, let them get a yid out of prison!

    The Iowa Independent and Lynda Waddington should be ashamed. There's a concept you should know of called fairness.

    You're informing your readers the 'facts' of the Rubashkin as told by Bloom? A guy who hates Rubashkin? That's ludicrous.

    And you write that Bloom is correct, he said “Chabad” would rush to cry Antisemitism, and you bring proof from what you decided is the official Chabad website. Did you call Chabad? Did you research it? Did you see it on Chabad.org, the official Chabad website? Did you contact the official Chabad spokesperson?

    Couldn't I just as easily buy the domain http://www.iowaindependent.info. and post trash in your name?

    Do you even care? Or is this version of reporting more fun for you?

      mottelfriedman, point well taken. I didn't look closely enough and mistakenly believed that chabad.info was also owned/published by chabad.org

      After reviewing the registration information for the domain, I've updated my story to reflect both the mistake and the correction.

      The chabad.info site is registered using the same information as the Central Chabad Lubavitch of Tel Aviv while the chabad.org site is registered to the Chabad Lubavitch Media Center.

    Good story Lynda:
    Bloom is correct in tagging Shalom Rubashkin as imperial not so much in words but in deeds. He saw no reason to pay the bank as called for in his loan agreement so that he could use bank funds to pay for other pet projects in Postville and then anything left he would send to the bank. What many of SMR's supporters don't seem to understand is that the man has been found guilty. They need to learn a lesson here. They're not in Nevel Russia anymore and the world works according to a higher level of ethical behavior.

        I have spent the better part of my professional life aiding and assisting Jews in need, including Holocaust survivors. I have traveled to Russia, Turkey, and Israel to insure funds for those in need are properly spent. I have fought anti-Semitism in the US, Canada, England and many, many other countries so I will put my credentials up against yours and SMR's combined, any day of the week. I also have extensive experience in the food industry and have been in many food processing plants in the US and Israel.
        That said, I suggest you stop trying to parse words. This is not baba matziya. SMR is guilty. He is not a saint, he is a crook – signed, sealed and delivered to jail. What he did han nothing to with Judaism or Jewish values. What he did had to do with greed and using his alleged religiosity to try and justify his greed is a giant Chilul HaShem – desegration of G-d's name.

          You say you have been in many food processing plants. I suggest you also go to Postville and judge for yourself and speak to the people.

          Sholom is a philantropist. He is a selfless person who has helped thousands and thousands of Jews and non-Jews in need. He might have made some mistakes but this was to help others. He did not benefit personally from any of these wrongdoings. He himself lived in a very modest house. He gave donations left and right helping other people. His plant was super clean and modern. I know this from someone who visited the plant and interviewed the employees. The workers loved working for him. Even the prosecutors' witnesses (workers) only had something good to say about him even though they were threatened by the prosecutors to speak against Rubashkin or face 10 years prison. This US judicial system is corrupt.

          Hundreds of stories of his discreet generosity have emerged. One such, told by a young boy who witnessed Mr. Sholom Rubashkin coming out of the bank with 10,000 in Cash. He encountered a worried individual and asked for the reason of his concern. When he learned that this poor man was marrying off his daughter and did not have a penny to his name, Sholom, without any fanfare took the 10k in cash and put it in this mans pocket and walked away. This is the person the prosecutors want to put in prison for life. If this is not anti-semitism, what is it?

          Mr. Rubashkin did not get a fair trial. The judge sent the jury out whenever the defense brought in its witnesses to testify about his generosity and his high character. Is this fair? No politicians (like the mayor of Postville and the governor of Iowa) were allowed to testify for Rubashkin. Is this fair? I think the judge should be independent. But here the prosecutor is the judge. Is this fair? I personally think this judicial system in the US has a serious flaw. The trial was biased from the very beginning. All these accusations (money laundering, drugs, weapons, etc) were baseless and false. They intentionally fabricated lies after lies to get him in prison as long as possible. Nothing is proven. All rumors and lies.

          Regarding Mr.Rubashkin’s conviction on bank fraud and the subsequent request that he be given what amounts to a life sentence is simply unfathomable. He never requested more from the bank then his original $35 million dollar line of credit. He might have overestimated the receivables but he always made timely payments with interest on all his loans. Even the bank acknowledged receiving approximately twenty-one million dollars in profit from the interest payments throughout the life span of the loan granted Mr. Rubashkin. The bank was more than thrilled to continue having Mr. Rubashkin as a client.

          The reason Mr. Rubashkin discontinued reimbursing the bank for the loans was due to the highly publicized inexplicable nature of the government’s raid on his plant, which resulted in the entire enterprise being forced into bankruptcy, he was left with absolutely no funds.

          Did you know that he could have sold the company (after the raid) and pay off the loan but the prosecutors hindered the sale. They threatened to prosecute any willing buyer. Thus, the prosecutors caused the bankruptcy, which then resulted in the “bank fraud”. But this is not bank fraud. He was totally incapable of repaying any portion of the loans from personal money because as a result of his enormous philanthropic endeavors and total selfless commitment over the years to the support of literally hundreds and hundreds of destitute needy individuals, coupled with his most generous donations to many worthy institutions and charitable organizations, he was entirely depleted of personal monies.

          Prosecutors were not content to charge Rubashkin with the offense of violating the immigration laws and bank fraud. In order to aggravate the appearance of his offense for publicity purposes, they returned seven successive indictments, constantly increasing the number of counts until the total was 163. No other employer who was the subject of an ICE immigration raid between 2006-2008 had seven superseding indictments returned against him with ever-increasing numbers of criminal counts.

          The prosecutors not only ruined Rubashkins’ business. They ruined the community. Rubashkin’s plant was the only major business in this town. They destroyed the local economy in Postville. They are the ones that really mistreated the workers and caused unemployment. In my opinion, the prosecutors are the ones that really belong in prison for all the evil they did to an innocent and noble person. May we see the true judgment by the G-d Almighty speedily in our days!

    I find it quite absurd that the reporter would dedicate a large part of her story to a comment that could have easily have been written by a ten year old.
    Usually the ones who do post such comments are those who don't have an ear to listen to them in real life and therefore post it on the internet where chances are more people will get to know of their rantings.

    However, being that the reporter wants to portray Rubashkin's supporters in a negative light, she resorts to looking for crazy comments on a website whom she asserts (without any basis) that the website is the official Chabad one before being called out on it. She then then asserts that it is a prominent one, when in fact the website is actually one belonging to a fringe element of Chabad.

    Not that I am surprised at all regarding the reporting of Lynda Waddington, her “news reports” regarding Rubashkin seem to be more like opinion pieces.

    In this article alone she writes “In a perhaps naive move”… “some members of the Jewish community in Postville…”

    I don't what motivates you Mrs. Waddington, but your reporting reveals more about yourself than about Mr Rubashkin.

    One small quibble with the article. The fourth paragraph starts “The Jewish community in Postville…” It should read “The Orthodox Jewish community in Postville…”
    Not all Jews support SMR. In fact very few support him. It is only the minority “super” orthodox who think he should be given bail.
